Expert Privacy Consultants: Navigate TDPSA with Clarity & Confidence
The Texas Data Privacy and Security Act (TDPSA) introduces a fresh regulatory framework for how organisations must handle personal data of Texas residents. At The DPG, we provide tailored TDPSA consultancy that helps your organisation interpret what’s required, reduce compliance risk and embed responsible data practices. Ultimately, we’re on hand to help you operate with confidence, earn consumer trust and allow privacy to support your business performance and drive growth, rather than hinder it.
Know Your Responsibilities Under Texas’ Data Privacy Law: The TDPSA Explained
Does the TDPSA Apply to My Business?
If your organisation conducts business in Texas (or targets Texas residents with products or services) and processes or sells personal data, TDPSA may apply. Broadly, the Act applies to entities that process personal data of 50,000 or more consumers per year (or derive revenue from the sale of personal data), or generate over 25% of revenue from selling personal data. The TDPSA excludes small businesses (as defined by the U.S. Small Business Administration), however, these organisations must obtain consent before selling sensitive data. Understanding your obligations is key to reducing enforcement risk, strengthening consumer confidence and maintaining credibility in a state that’s seen an economic boom over the past few years.
What Are the Risks of Non-Compliance?
Non-compliance with the TDPSA can lead to serious financial and reputational consequences. A company that violates the Act after the Attorney General’s 30-day cure period, or breaches a written statement of remediation, may face civil penalties of up to $7,500 per violation. Beyond fines, failure to comply can undermine consumer trust, invite scrutiny from regulators and partners, cause significant reputational damage and block entry into wider U.S. markets that expect modern privacy standards. A proactive approach to compliance not only limits exposure but also demonstrates a commitment to ethical data stewardship and transparency. Taking action early also ensures your organisation builds stakeholder confidence and positions privacy as a competitive advantage.
Can TDPSA Compliance Strengthen Customer Loyalty?
Absolutely. Demonstrating compliance with the TDPSA signals that your organisation values consumer rights such as access, correction, deletion, and opt-out of data processing for targeted advertising. This level of transparency helps you build trust and loyalty among Texas consumers, stand out against competitors with weaker privacy practices and align your brand with responsible innovation and digital trust. In an era where consumers choose brands that respect their data, leading with transparency under the TDPSA can turn compliance into a genuine differentiator.
What Steps Should My Organisation Take First?
The best place to start is with a TDPSA readiness or gap assessment. This review identifies how personal data flows through your organisation and highlights areas that need attention, such as privacy notices and consent mechanisms, to supplier management and governance. Our data privacy consultants can help you map and document data processing activities and assess compliance against TDPSA principles (lawfulness, purpose limitation, minimisation, etc.). We will also help you develop policies and staff training to maintain accountability and embed privacy as a driver of business trust.

CCPA FAQs: What You Need to Know
Not sure where to start with CCPA? Don’t worry, data privacy can be complex at the best of times, but with the right guidance, it doesn’t have to be. At The DPG, we offer clear, practical CCPA consultancy backed by real-world experience. Below, we’ve outlined several answers to some of the most common questions, but if you have a particular query in mind, please don’t hesitate to reach out to a member of our team.
The California Privacy Rights Act (CPRA) is an amendment to the original CCPA that expands consumer rights, introduces stricter rules around data sharing, and creates a dedicated enforcement body, the California Privacy Protection Agency (CPPA). The CPRA also adds obligations for sensitive personal information, limits retention periods and removes the 30-day cure period for violations.
Any California resident (whether a customer, employee or business contact) has rights under the CCPA. These include the right to know what personal data is collected, to request deletion, to opt out of data sales or sharing and to correct inaccurate information.
Start with a CCPA gap analysis with The DPG. We can help you uncover risk areas in how you collect, process and share data. Our experienced team can also help you build or refine your privacy notice, establish clear opt-out and deletion workflows, and audit third-party data relationships. We would also suggest putting plans in place for a clear governance framework as well as staff training — these are critical for reducing regulatory exposure.
Under the CCPA, “personal information” includes a wide range of data that can identify or relate to a California resident. This includes names, emails, IP addresses, biometric data, geolocation, browsing behaviour, and inferences drawn to create consumer profiles.
